24. How Attorneys Can Share General Educational Information Responsibly

Legal questions often arise during major personal and business decisions. People may want to understand contracts, estate planning, business formation, employment matters, immigration procedures, family law, intellectual property, real estate transactions, or dispute resolution. Attorneys can build professional visibility by explaining legal concepts clearly, but they must distinguish public education from advice for a particular person’s circumstances.

Attorneys can create articles, interviews, videos, checklists, and public discussions that explain how a legal process generally works. Useful topics might include questions to ask before signing a contract, why businesses need written agreements, what families should consider when preparing an estate plan, or when intellectual property protection may deserve attention.

Educational information should acknowledge that laws, deadlines, procedures, and legal rights vary by jurisdiction and can change. Hypothetical examples should be identified as illustrations rather than predictions of how an actual matter would be resolved. Attorneys should avoid declaring what a particular person “should” do without reviewing the relevant facts and establishing an appropriate professional relationship.

A clear disclaimer can explain that the material is provided for general informational purposes, does not constitute legal advice, and does not create an attorney-client relationship. However, a disclaimer alone cannot correct content that is misleading or effectively provides individualized advice.

Protect Confidentiality and Manage Public Questions

Attorneys must be careful when using client stories, case results, testimonials, documents, or courtroom experiences. Information relating to a representation generally cannot be disclosed merely because some facts are publicly available. Client examples should be used only when ethically permissible and with any required informed consent. The ABA Model Rules provide an important framework, but attorneys must follow the rules governing every jurisdiction in which they practice.

Public events and online comment sections create additional risks. Audience members may reveal confidential or conflict-sensitive information while asking questions. Attorneys can invite general questions while directing people with specific matters to an appropriate private intake process. Even when no representation follows, duties may arise when someone consults an attorney about possibly forming an attorney-client relationship, as addressed by ABA Model Rule 1.18.

Professional profiles should represent an attorney’s experience, admissions, certifications, practice areas, results, and affiliations accurately. Communications should not guarantee outcomes, create unjustified expectations, or omit information that makes a statement misleading. Attorneys should review applicable advertising, solicitation, specialization, testimonial, and recordkeeping rules before publishing promotional content. The ABA permits lawyers to communicate information about their services through different media, subject to professional-conduct requirements (Rules 7.1–7.2).
